Familiarity with State and Federal Regulations, and Expert Testimony JSAI is familiar with New Mexico Office of the State Engineer (NMOSE) and New Mexico Environment Department (NMED) regulations, as related to water-rights, drilling and well-completion, and water-quality matters. We are also very familiar with the Texas Natural Resources Conservation Commission regulations related to environmental and drilling issues.
We have provided hydrogeological services for hundreds of wells drilled under NMOSE permits, spanning the range from shallow monitor wells to complex supply wells more than 3,000 ft deep (many other wells, including the most demanding, were outside of NMOSE declared basins when they were drilled). These have involved NMOSE and NMED well-construction regulations, and in many cases we have sought and received variances for casing and cementing programs that were more suitable for the conditions than the procedures called for in the regulations.
Our recent four-well project for Los Alamos National Laboratories has involved the most rigorous application of State and Federal regulations in every aspect of the job, including land-use permitting, health-and-safety issues, and discharge of water during development and testing.
JSAI was selected by the NMOSE to provide hydrogeological consulting services for three nested piezometers, in the 1,700-ft range, in Albuquerque and Rio Rancho.
JSAI has prepared studies, exhibits, and testimony for over 20 State Engineer water-rights hearings, beginning in 1982, and has prepared many other applications, and supporting studies, that did not require public hearing. We are very familiar with the permitting process, including the information and analysis generally required to successfully support an application for a well, and we have worked cooperatively and efficiently with NMOSE staff over the years.
Expert Testimony Having provided sworn testimony in interstate litigation before United States Supreme Court Special Master, in New Mexico District Court, and in 20 State Engineer water-rights hearings, John Shomaker is very familiar with and highly qualified in the intricacies of western water rights and New Mexico water administration. His work related to interstate stream compacts includes testimony regarding the dispute between Colorado and Kansas over allocation of the Arkansas River, analysis of the Pecos River Compact, involving New Mexico and Texas, for the Pecos Valley Artesian Conservancy District, and familiarity with the Rio Grande Compact, which addresses the apportionment of the Rio Grande between Colorado, New Mexico, and Texas. Dr. Shomaker is also experienced in dealings with water rights associated with the San Juan-Chama Project.
